A-Game To Stay Open Through March As Mediation Puts Off Court Date

After spending the entire day in mediation on Feb. 17, a long-term agreement between the owners of A-Game Sportsplex and their tenants, Alliance Volleyball and MDG Management was not reached.

But the parties agreed to continue trying to figure out a solution that everyone can agree to. Yesterday, Feb 25, A-Game agreed to stay open through March 31.

A sign that progress has been made also came on Thursday, when both sides agreed to put off litigation indefinitely . A hearing had been scheduled for 1 p.m. in the lawsuit against A-Game, in which the sports groups are suing A-Game for trying to terminate their leases years early in order to complete a sale of the property to AL Neyer.

Among other reasons, A-Game claimed as justification for the termination, that Alliance had been late paying its rent several times. Jeff Wismer, executive director for Alliance, and other club officials claimed in depositions under oath, however, that these claims were false and that rent was always paid immediately after receiving invoices from A-Game.

When it was announced that the issue would go to a mediator almost two weeks ago, A-Game agreed to reopen until the next court date- which was to be Thursday- after shutting its doors  on Feb. 4, a few days after a favorable ruling in the lawsuit.

A court filing on Thursday read:

“On Wednesday, February 17, 2016 the parties participated in an all-day mediation before Edward Silva, a certified mediator. While the parties were unable to reach a resolution at this mediation, the parties have agreed to continue to engage in good faith discussions to explore whether a mutual resolution of this matter is possible

A source close to the situation said that A-Game had made some short-term concessions. Mediation will continue between the two parties but no specific dates have been announced.”
