Local Salon and Barber Shop Citations

The State of Tennessee, for nearly 90 years, has regulated the licensing of barbershops and beauty salons with the goal of not just setting high standards of service but protecting the safety and health of all who frequent them. This job belongs to the state regulatory Board of Cosmetologists and Barber Examiners. It sets rules and to ensure them sends inspectors to all corners. It is no small task. Across the state, according to that board, there are currently 8,550 cosmetology shops, 51,000 cosmetologists, manicurists, aestheticians and natural hair stylists whose numbers are buttressed by the many and various beauty schools, of which there are 80 private, 65 public, 35 vocational and 3 correctional; and add to those the 2,050 barber shops, 5,000 master barbers and 23 barber schools.

In a moment we will get to the big list of barbershops, nail salons, beauty schools and so on cited in our area in the past year for breaking the board’s rules. But first a bit about the rules.

The board and its inspectors focus on two things: regulating licensing and repelling potential health hazards. Regulating licensing ensures that only qualified persons are certified, permitted, or licensed and that once licensed, these persons uphold the highest appropriate professional standards of practice, independence, and competency. The benefit of public health concerns, as in preventing the spread of diseases through for instance reusing without sanitizing hair clippers and attachments, are self-evident. The board enforces strict rules for sterilizing of all appropriate accessories, areas and appendages.

All state establishments are inspected regularly. Violations lead to fines ranging from $100 to $250 for a first offense to $1000 for operating without a good license. A third violation can lead to a formal hearing and ultimately a suspended or revoked license.

*T.C.A. §56-1-109 is a State of Tennessee law that deals with state licensed activities. It states that if a licensee is a person who also has defaulted on federal or state guaranteed student loan, the state will rescind their license until the debt is paid or a plan set up to repay it has been established.

**T.C.A. § 36-5-71 is similar to T.C.A. §56-1-109, §56-1-312 but with regard to child support debt and nonpayment instead of student loans.
